By using this website or engaging Brennan Work Solutions, you agree to these website terms and service terms and conditions. A signed proposal or written terms of reference may add detail for a particular assignment.

What the key words mean

“Brennan Work Solutions” means the HR consultancy providing the relevant service. “Client” means the organisation or person accepting a proposal or asking us to begin work. “Services” means the HR advisory, talent acquisition, employee relations, policy, performance or training work agreed in writing.

02 / ENGAGEMENT

Services and engagement

The agreed scope controls the work. We will set out the expected deliverables, timing and fees in a proposal or terms of reference.

Starting the work

An engagement begins when the Client accepts a proposal, confirms written terms or instructs Brennan Work Solutions to proceed after scope and fees have been agreed.

Client responsibilities

The Client must provide accurate information, identify relevant deadlines and give reasonable access to people and records needed for the assignment.

Advice has a defined purpose

  • HR advice is based on the facts and instructions available when it is given.
  • Recruitment support depends on timely feedback, accurate role information and lawful selection decisions by the Client.
  • Training and policy work should be adapted by the Client to its own workforce, contracts and operating practices.
03 / MATERIALS

Intellectual property and materials

The work may be tailored to your organisation, while the underlying methods and materials remain protected.

Internal use is permitted.

How clients may use our work

Unless a written agreement says otherwise, intellectual property in templates, policy structures, training content and related materials remains with Brennan Work Solutions or its licensors. Once agreed fees are paid, the Client receives a non-exclusive licence to use the supplied materials for its own internal business purposes.

Materials must not be resold, published for public access, shared outside the Client’s organisation or adapted for another business without written permission. The Client may make reasonable internal copies for managers and staff who need them.

For example, an employee handbook prepared for one Client may be used within that Client’s organisation. It is not a general product for resale.

04 / RESPONSIBILITY

Limitation of liability

HR consulting supports decisions. The Client remains responsible for the decisions it makes and the actions it takes.

Keep the final decision in-house.

A proportionate approach

Brennan Work Solutions will provide the Services with reasonable care and skill. Advice is not a substitute for legal, tax or specialist professional advice where that advice is required.

To the extent permitted by Irish law, Brennan Work Solutions is not liable for indirect loss, loss of profit or loss arising from a Client decision made without following the agreed advice or without checking that the underlying facts remain accurate.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud or personal injury caused by negligence. Any agreed financial limit will be set out in the relevant proposal or written agreement and will reflect the nature of the Services and available professional indemnity cover.

05 / LEGAL BASIS

Governing law and jurisdiction

These terms and any dispute connected with them are governed by the laws of Ireland. The courts of Ireland have jurisdiction, subject to any mandatory rights available to a consumer or other party under applicable law.

If a term is found to be invalid, the remaining terms continue to apply. Contact Brennan Work Solutions before engaging our services if a clause needs clarification.
